Tour Purchase and Confirmation

Once you purchase your tour, you will receive a generated receipt. Within 24 to 48 hours, we will send you a second email containing instructions on where to meet and your tour information. PLEASE CHECK YOUR SPAM/JUNK FOLDER if you do not see this email in your inbox within that timeframe. To ensure our emails reach your inbox, please add info@tampamafia.com to your address book.

Disclaimers

1. Final Purchase Policy:
ALL PURCHASES ARE FINAL. We do not offer refunds under any circumstances. This policy is strictly adhered to, and no exceptions will be made.

2. Rescheduling Policy:
If you are unable to attend your original Tampa Mafia Walking Tour date, you are granted ONE opportunity to reschedule to any available future Tour. IMPORTANT: You must NOTIFY US at least 48 hours before your scheduled Tour date to take advantage of this option. Your space on the Tour is transferable.

3. No-Show Policy:
If you are a no-show for your scheduled Tour, we cannot place you on any future Tour dates.

4. Weather Policy:
If weather conditions necessitate a change, your Tour will be rescheduled at your choosing to one of our scheduled tours listed on our website. NO REFUNDS will be issued. This does not apply to Private or Group tours.

5. Age Restrictions:
NO CHILDREN UNDER THE AGE OF 12 are permitted. Discretion is advised for all children aged 12-16.

6. Guide Changes:
We reserve the right to change the Tour guide listed on your Tour without notice. While we will make every effort to have the specific tour guide lead your Tour, emergencies may arise.

7. Tour Cancellation Policy:
Tampa Mafia Tours reserves the right to cancel Tours with fewer than six attendees. In the event of a cancellation, you may either reschedule for another available Tour or receive a full refund.

8. Guest Conduct:
Our Tour guide has the authority to ask ANY guest to leave the Tour for any reason they deem necessary.

9. Recording Prohibition:
VIDEO OR TAPING OF THIS TOUR IS STRICTLY PROHIBITED.

10. Billing Information:
Your credit card will be billed under our parent company, Cigar Heritage Festival, Inc.

WAIVER AND RELEASE OF LIABILITY
This Waiver and Release Agreement ("Agreement") is entered into by and between the tour participant ("Participant") and Cigar Heritage Festival, Inc., S4 Enterprises LLC, Tampa Mafia, and any affiliated entities (collectively referred to as "Sponsors").

1. Definitions
• "Participant": Any individual purchasing or joining the Tour.
• "Sponsors": Cigar Heritage Festival, Inc., S4 Enterprises LLC, Tampa Mafia, and their affiliates.
• "Tour": The Tampa Mafia Tour and all related activities.

2. Acknowledgment of Risks
Participant acknowledges the inherent risks associated with the Tour, including but not limited to:
• Physical exertion
• Uneven terrain
• Weather extremes
• Potential interactions with animals
• Other risks that may arise during the Tour

3. Waiver and Release
Participant hereby waives any claims against and releases Sponsors from all liability for any personal injury, death, property damage, or loss sustained as a result of participation in the Tour. This includes claims arising from COVID-19 or ANY other virus exposure.

4. Health and Safety
Participant agrees to disclose any medical conditions that may hinder their ability to safely participate in the Tour.

5. Medical Treatment
Participant agrees that, should an injury or illness occur, Sponsors may arrange for medical treatment and emergency evacuation at Participant's cost.

6. Use of Likeness
Participant grants Sponsors a worldwide, royalty-free license to use their photographic, video, or digital likeness captured during the Tour for promotional, educational, and commercial purposes. This includes, but is not limited to, use on social media, in brochures, and in other marketing materials.

7. Compliance with Instructions
Participant agrees to follow all instructions from Sponsors. Non-compliance may result in injury or removal from the Tour without refund.

8. Indemnification
If Participant violates this Agreement and attempts to bring suit against any party named herein, Participant agrees to pay all attorney's fees and costs incurred in defending against such action.

9. No Refund Policy
Participant acknowledges that once the Tour is purchased, there are no refunds for the Tour, regardless of circumstances, unless required by law.

10. Severability
If any part of this Agreement is found to be unenforceable, the remaining sections will still be valid and enforceable.

11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

12. Acknowledgment of Understanding
Participant affirms that they are entering this Agreement voluntarily and have read and understood the Terms and Conditions before purchasing their Tour. Participant has the right to consult with legal counsel regarding this Agreement.

13. Free Will
By purchasing the Tour for yourself and/or your guests, you confirm that you fully understand and agree to these Terms and Conditions and the Waiver and Release of Liability. You acknowledge that you are responsible for informing any guests you purchase a Tour for that they understand and agree to these terms.
